Douglas County Commissioners file petition for rehearing in open meetings case

On April 16, Douglas County Commissioners filed a petition for rehearing with the Colorado Court of Appeals following the court’s recent decision involving Colorado’s Open Meetings Law.

The petition asks the court to modify portions of its opinion the Board believes prematurely decided alleged Open Meetings Law violations before the case has been fully litigated on its merits.

A petition for rehearing is a process allowed under court rules that permits the court to revise or clarify aspects of a decision.

Commissioners have maintained throughout this case that greater clarity is needed regarding how Colorado’s Open Meetings Law applies to public bodies across the state. This clarity is important because the issues raised in this litigation may affect local governments, boards and elected bodies beyond The Board of Douglas County Commissioners.

Commissioners remain committed to transparency, open government and conducting public business in accordance with state law. Additional updates will be shared as the case proceeds through the courts.
